These International Terms and Conditions of Sale (“Terms”) apply to all purchases made through the Safiara Essentials e-commerce website(s) and any associated digital platforms (collectively, the “Website”) globally. By placing an order, you confirm that you are at least eighteen (18) years of age (or the age of legal majority in your jurisdiction) and have the legal capacity to enter into a binding contract. When these Terms mention “Safiara Essentials”, “we,” “us.” Or “our,”, it refers to the Safiara Essentials Cosmetics Trading L.L.C S.O.C., as further defined in our Terms and Conditions. If you use any of our services, we will refer to you by using the terms “user”, “visitor”, “you”, “your”, “yours” in these Terms.

We are a brand of Safiara Essentials Cosmetics Trading L.L.C S.O.C., a company registered under Department of Economic Development, with the trade license number 1568177, and registered address Building No. 06 Off 02 Oud Metha Dubai, United Arab Emirates.

However, you may not provide personal information to us, make a purchase on the Website nor register on the Website, and can only do so at the age of majority in your jurisdiction. This Website is not directed to children under 13 years old. By accessing or using the Website, you are acknowledging that you have read, understand, and agree, without limitation or qualification, to be bound by these Terms
Products and Descriptions
We make reasonable efforts to ensure that product descriptions, images, ingredients lists, and pricing on the Site are accurate. Colors and packaging may vary slightly from images shown due to display settings or manufacturing variation. We reserve the right to correct pricing or descriptive errors and to cancel any order affected by such an error, in which case you will be notified.
Orders and Acceptance
By placing an order, you are offering to purchase a product on and subject to the following Terms. An order is only accepted, and a legally binding contract is formed, once we dispatch your order and send you a dispatch confirmation email. We reserve the right to refuse or cancel orders prior to dispatch. An acknowledgement of your order is not an acceptance of your order. We may decline to accept an order for any reason, including but not limited to unavailability of stock, inability to obtain payment authorization, or suspected fraud.
All orders are subject to availability and confirmation of the order price.
If your order is accepted, we will inform you by email. When placing an order, you undertake that all details you provide to us are true and accurate, that you are an authorized user of the credit card, debit card, payment account or payment platform used to place your order and that there are sufficient funds to cover the cost of the goods. The cost of products and services may fluctuate. All prices advertised are subject to such changes. Please be aware that some of the goods sold through our Website may not be suitable for children under 18 years of age, so please take extra care when purchasing goods as gifts, for under 18s
Contract Formation
This Website is operated by Safiara Essentials. If you have any questions, whether about our products and services, this Website or otherwise, please contact our Customer Service team at info@safiara.ae.
After placing you an order, you will receive an email from Safiara Essentials, acknowledging that we received your order (the “Order Confirmation”).
Please note that this does not mean that your order has been accepted, or the contract has been formed. Your order constitutes an offer to us to buy a product or service. All orders are subject to acceptance by Safiara Essentials, and we will confirm such acceptance to you by sending you an email that confirms that the products have been dispatched (the “Dispatch Confirmation”). The contract between us (the “Contract”) will only be formed once we send you the Dispatch Confirmation. The Contract will relate only to those products whose dispatch we have confirmed.
No Resale Term
You agree that all products and services purchased through our website are intended for personal use and not for resale. We strictly prohibit the purchase of product for commercial resale or distribution. By placing an order, you represent and warrant that you are buying products for your own personal and/or professional use and not for resale.
We reserve the right, at our sole discretion, to limit the quantity of items purchased per person, per household, or per order. These restrictions may include orders placed by or under the same account number, the same payment method, and/or orders that use the same billing or shipping address.
If we reasonably believe that your order has been made with the intent to resell, we reserve the right to cancel the order, suspend or terminate your account, and take any legal action necessary to enforce this policy.
Promotional and Bundle Items
Items purchased as part of discounted bundle or promotional set must be returned in full as a set, unopened and sealed due to health and safety reasons to be eligible for a refund. Partial returns from a bundle may not be accepted or may be refunded at the bundle’s discounted per-item value, not the full individual price. Such promotional offers are available whilst stocks last.
Pricing and Payment
All prices are displayed in AED (UAE Dirhams) and are inclusive of applicable UAE Value Added Tax (VAT) unless stated otherwise. We accept the payment methods indicated at checkout, processed via secure third-party payment gateways. Full payment is required before an order is dispatched, unless cash on delivery is offered and selected.
Intellectual Property
All information and content available on the Website and its look and feel, including but not limited to trademarks, logos, service marks, features, functions, text, graphics, logos, button icons, images, audio clips, data compilations and software, and the compilation and organisation thereof (collectively, the "Content") is the property of Safiara Essentials is protected by United Arab Emirates, including laws governing copyrights and trademarks.
Except as set forth in the limited licenses in section below, or as required under applicable law, neither the Content nor any portion of the Website may be used, reproduced, duplicated, copied, sold, resold, accessed, modified, or otherwise exploited, in whole or in part, for any purpose without our express, prior written consent
Limitation of Liability
To the fullest extent permitted under UAE law, Safiara Essentials shall not be liable for any indirect, incidental, or consequential loss arising from use of the Site or our products, except where such liability cannot be excluded by law (including in cases of proven negligence, wilful misconduct, or as required under UAE consumer protection legislation). Nothing in these Terms limits any right you have under Federal Law No. 15 of 2020 on Consumer Protection or its executive regulations
Due to the nature of this Website and the potential for errors in the storage and transmission of digital information, we do not warrant the accuracy and security of information transmitted to or obtained from this Website unless otherwise expressly set out on this Website. All product descriptions, information and materials posted on this Website are provided "as is" and without warranties express, implied or otherwise howsoever arising.
Our liability in connection with any product purchased through our Website is strictly limited to the purchase price of that product. Nothing in this Clause will affect your statutory rights as a consumer or your Contract cancellation rights.
To the fullest extent permitted by applicable law, neither we nor our, affiliates, partners, or licensors will be liable in contract, warranty, or in tort (including negligence) for any indirect, special, incidental, or consequential damages of any kind (including lost profits) related to the Website or your use thereof, even if we have been advised of the possibility of such damages. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
To the extent permitted by applicable law, no claim or action in contract, warranty, or in tort (including negligence) arising out of, or related to, the use of the Website or these Terms may be brought more than one (1) year after the cause of action arose. This does not apply where a longer period is required by mandatory law (including consumer protection law) in your country of residence.

Disputes
Arbitration clause: Except for claims for injunctive or equitable relief or claims regarding intellectual property rights (which may be brought in any competent court without the posting of a bond), any dispute, claim, or controversy regarding the Website shall be finally settled by arbitration administered by the Dubai International Arbitration Centre ("DIAC") under the DIAC Arbitration Rules in force at the time the arbitration is commenced, by three arbitrators appointed in accordance with such Rules. The arbitration shall take place in Dubai, United Arab Emirates, in the English language and the arbitral decision may be enforced in any court of competent jurisdiction. The prevailing party in any action or proceeding to enforce the Agreement shall be entitled to costs and attorneys' fees.
To the fullest extent permitted by applicable law, you agree that any arbitration or proceeding shall be limited to the dispute between us and you individually, and (i) no arbitration or proceeding shall be joined with any other; (ii) there is no right or authority for any dispute to be arbitrated or resolved on a class, collective, consolidated, or representative basis or to utilise class action procedures; and (iii) there is no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or any other persons. This does not limit any rights you may have under mandatory consumer protection laws in your country of residence where such limitations are prohibited. YOU AGREE THAT YOU MAY BRING CLAIMS AGAINST US ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
Severability
If any of these Terms or any provisions of a contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.
Governing Law and Jurisdiction
Except to the extent any applicable law provides otherwise, these Terms and any access to or use of our Services will be governed by the laws of the United Arab Emirates, excluding its conflict of law provisions. The proper venue for any disputes arising out of or relating to the Terms and any access to or use of our Services that are not otherwise subject to arbitration (as indicated below) will be the state and federal courts located in Dubai, United Arab Emirates.
